Booking Conditions

Here you will find all necessary details about booking conditions, cancellation policies as well as general conditions.

Please note! By making the prepayment you are agreeing to the Castles booking conditions.

BOOKING CONDITIONS

(1.1) The Client shall submit the rental of premises, ordering tickets for events, visiting the museum, etc. (hereinafter the Event), ordering catering services or ordering a coffee / wine break (hereinafter the Order) by telephone or e-mail.

 

(1.2) Keila-Joa Castle (hereinafter the Castle) processes all Orders according to the order of their receipt.
 

(1.3) The Customer is considered to be a natural or legal person (hereinafter the Customer) who has submitted the Order.
 

(1.4) In accordance with the Order, the Castle shall submit a written offer containing a description of the service, the price and, if necessary, the period of validity of the offer and other information necessary for the performance of the Event (hereinafter the Offer).
 

(1.5) The price of the food in the Offer submitted by the castle includes the dishes and serving equipment necessary for serving the food. In the case of ordering individual services, the Castle Offer includes an approximate quantity and price, which will be adjusted later during the specification of the Order.
 

(1.6) The Offer is valid in its entirety and the Castle shall submit a new adjusted Offer except for the change of the Order data by the Customer. in the case set out in point 1.7.
 

(1.7) The Customer has the right to change the number of participants indicated in the Order / Offer up to 30 calendar days before the event, according to which the Castle will adjust the volume of catering and other ordered services if possible. Subsequent changes by the Customer will be accepted by the Castle only if possible by prior agreement.
 

(1.8) If the Customer amends the submitted Order so that the services of the Castle are ordered as a supplement to the catering services of the third party (ies), the Castle has the right to refuse the Order.
 

(1.9) The Client is obliged to confirm the Offer in writing by the deadline set by the Castle. Confirmation is the return of the Offer together with the Customer’s consent by e-mail to info@shlossfall.com.
 

(1.10) It is possible to pay for the order at the Service Provider or on the basis of an invoice.
 

(1.11) The invoices submitted by the castle (advance payment invoice and final payment) must be paid by the payment deadline indicated on the invoice.
 

(1.12) Receiving a quote does not mean confirming the booking. The reservation is confirmed with a 50% prepayment.
 

(1.13) The reservation must be canceled if it turns out that the service cannot be used on the desired date.
 

(1.14) If the invoices submitted by the Castle are not paid on time by the Customer, the Castle has the right to cancel the reservations.
 

(1.15) Upon payment of an advance payment or other invoice, the Customer confirms that he has previously read the terms of use of the service.

PAYMENT FOR EVENTS AND TICKETS

(2.1) A reservation made at the service provider, by calling or by e-mail shall be paid for on the basis of the invoice and conditions submitted after the reservation has been made.
 

(2.2) After booking the Order, we will send you a prepayment invoice within 50 working days, which is 50% of the total cost of the event. The reservation takes effect after payment in advance. The order will be confirmed upon 50% prepayment.
 

(2.3) The final payment will be sent no later than 35 days before the event.
 

(2.4) The full amount of the Order must be paid no later than 30 days before the event.
 

(2.5) If you wish to cancel the Order more than 30 days before the Service takes place, you may use the previously paid prepayment to pay for a future Order.
 

(2.6) Services / Orders added during the event must be paid for on the same day at the end of the event at the latest.

CHANGE

(3.1) Change of personal data The Order (name, contact) does not have to change the Order.
 

(3.2) The order can always be changed if the changed services are paid for according to the price list of the Service Provider. Upon changing the final price of the order, the price arising from the difference between the price of the services originally ordered and the services changed in the reservation and the applicable Penalty in accordance with subsections 3.4.1 and 3.4.2 of this clause must be paid.
 

(3.3) If the Order is changed more than 31 days before the Order takes place, the Contractual Penalty shall not be applied.
 

(3.4) The contractual penalty is applied as follows:
 

(3.4.1) if the Order is changed less than 30 days before the Order is placed and the changed Order is cheaper, 10% of the total cost of the Order will be withheld and the difference in price as the next residual balance will be refunded.
 

(3.4.2) if changes are made to the Order less than 14 days before the Order takes place and the modified Order is cheaper, the Contract originally purchased shall be retained as a Contractual Penalty and at the same time the Contractual Penalty shall be applied to additional services in accordance with clause 3.5.
 

(3.5) If the order is changed for additional services less than 14 days before the event, the cost of additional services will be deducted as a contractual penalty.

CANCELLATION

(4.1) The service provider cancels the booking of an event for which no payment has been made by the due date.
 

(4.2) The date of cancellation is the date on which the Castle has received the customer’s notice of the cancellation.
 

(4.3) Upon cancellation of the order, a Contractual Penalty is required on the basis of these Terms. In the case of services provided by third parties, the Contractual Penalty established by them shall apply.
 

(4.4) Upon cancellation of the Order, the amount paid for the event, less the Penalty, shall be returned to the same bank account from which the Order was paid. The rates and conditions of the contractual penalty are listed in clause 4.5
 

(4.5) The contractual penalty is applied as follows:
 

(4.5.1) If the Order is canceled 60 or more days before the provision of the service, 75% of the prepaid amount will be refunded.
 

(4.5.2) If the Order is canceled 59-31 days before using the service, 50% of the prepaid amount will be refunded.
 

(4.5.3) If the Order is canceled 30 days before using the service, the advance payment will not be refunded.
 

(4.5.4) If the Order, for which the full amount has been paid, is canceled less than 29 days before the use of the service, 20% of the total amount will be refunded.
 

(4.5.5) If the Order, for which the full amount has been paid, is canceled less than 14 days before the use of the service, the full cost of the service will not be refunded.
 

(4.5.6) If the cancellation of the Order is due to reasons beyond the control of the Customer and which can be documented, the Customer has the opportunity to choose a new suitable date.
 

(4.5.7) When refunding the advance payment, the booking fee will be deducted 7% of the total cost of the booked service.
 

(4.5.8) If you want to change the time of the Order, it will be considered as a cancellation of the reservation and making a new reservation.
 

(4.5.9) Upon cancellation of the Accommodation Order, the advance payment will not be refunded.
 

(4.6) Failure to appear on the order is excusable only due to force majeure circumstances and must be proven by the Customer. The circumstances of force majeure and the evidence submitted regarding them shall be assessed by the Service Provider. If the force majeure circumstance is proven, the amount paid for the Service will be refunded to the Customer and no Penalty will be applied.
 

(4.7) The Customer may leave the amount paid for the Order in advance to pay for the future services of the Service Provider.
 

(4.8) Any claims regarding the services provided by the Castle must be submitted in writing within 3 calendar days after the Event. Subsequent claims of the customer will not be considered.

GENERAL CONDITIONS

(5.1) On the basis of the Offer and at the time indicated in the Offer, the Castle shall provide the Customer with the use of the assets of the Castle.
 

(5.2) Upon accepting the price offer, the Client confirms:
 

(5.2.1) Use the property of the Castle purposefully and prudently.
 

(5.2.2) Get acquainted with the Rules of the Castle and follow the rules of the Castle using the premises of the Castle and the furniture, paintings and other objects contained therein (hereinafter Property), not using fire inside the Castle, Do not move in the territory of the castle by means of transport.
 

(5.2.3) Carry full material liability for damage to the Property during the Event in accordance with the legislation of  Estonia.
 

(5.2.4) Use the Schloss Fall restaurant in the Castle to order catering and alcohol.
 

(5.2.5) The customer (the person who made the reservation) is fully responsible for the activities of the group represented by him, incl. undertakes to compensate in full for the property damage caused to the Service Provider in accordance with the legislation of the Republic of Estonia.
 

(5.2.6) The Service Provider is not responsible for the personal belongings and assets of the Customer and his / her group.
 

(5.3) The Castle has the right to suspend the Event planned by the Customer in case of non-compliance with the conditions provided in the Offer and the Rules of Procedure.
 

(5.4) On the basis of the confirmed Offer, the Customer shall pay 50% of the advance payment to the Castle during the validity of the offer, thereby confirming his / her wish to receive the service. 100% of the Offer amount must be paid by the customer 30 days before receiving the service. If the Customer requests a prepaid invoice, he / she will notify the Castle in writing.
 

(5.5) In the event of late payment of the advance payment made on the basis of the offer / invoice, the Castle has the right to cancel the execution of the Order.
 

(5.6) After completing the Offer, the Castle shall, at the request of the Customer who has ordered the Service, submit an invoice showing the amount paid in advance.
 

(5.7) When paying for the Service, the name of the Customer, the date of provision of the Service and the Offer number (invoice number) must be indicated in the explanation of the payment order.
 

(5.8) Additional services / Orders made during the event must be paid for no later than the evening of the same day at the end of the event.
 

(5.9) The client is obliged to ensure that the castle and the territory of the castle are clean at the end of the event. Ensure that there are no smoke machines on the territory and that the castle is in the same condition after the decoration related to the event has been removed.
 

(5.10) By ordering a band for the event, the client must ensure that it does not damage the Castle or disturb the night peace.

TERMS OF USE FOR PRIVATE EVENTS

(6.1) In the event that the Customer makes a Reservation for the private use of castle hall or halls, the Castle provides the Customer with the use of the hall or halls specified in the offer (all main house I floor halls / fireplace hall / statue hall / restaurant) on the basis of the Reservation and for the period agreed, except the administrator's desk, staff rooms, kitchen rooms, wine cellar, area behind the bar counter and museum.

(6.2) The beginning of use of the premises. The client is given access to the Castle, including the opportunity to start preparing for the Event and using the castle halls starting from the booked time. For example, if your event starts at 17.00 and you need 2h to make preparations and sound checks you need to book these extra hours in advance. All preparations including bringing decorations, sound and photo box equipment, flowers, cake etc. need to be brought starting from the booked time. The Castle is not obligated to accept earlier arrival if not agreed otherwise.

(6.2.1) The end of use of the premises. The Customer has the right to use the booked castle halls until the end time of the reservation. At the end of the booked time, the premises must be completely vacated by the guests. Decorations and equipment must be removed from the premises at the end of the event if not agreed otherwise. All castle halls must be left in the same condition they were given to the Customer for use.

If the Customer does not vacay the premises at the end of the booked time they will be charged for the exceeded hours.

(6.3) During the private use of the castle halls the Customer is responsible and makes sure that his guests also use the premises and property of the Castle in a purposeful and in prudent manner.

(6.3.1) Own food and drink is not allowed at the Castle. In the absence of a different agreement, consuming your own food and drink in the Castle is prohibited. In case of violation of the mentioned prohibition, the Customer is obliged to pay a fine.

(6.4) In the event that the Customer wishes to use a live band, audiovisual, live fire solutions or magicians on the territory of the Castle, the Customer is obligated to coordinate in advance the corresponding solutions with the Castle in writing. 

(6.5) Fireworks and other pyrotechnics are prohibited to use at the Castle territory or in the surrounding area.

SAFETY

(7.1) It is forbidden to bring drinks and meals for consumption from outside to the Castle.
 

(7.2) Smoking is only allowed in designated areas. Smoking is strictly prohibited indoors.
 

(7.2.1) Disposal of smoke cones and rubbish is prohibited and a fine of € 300 will apply.
 

(7.3) Pets are allowed under the strict responsibility of the animal owner and must not move around freely, the animal must always be on a leash. A surcharge applies for pets.
 

(7.3.1) If the pet damages the property of the Castle, the owner of the animal is obliged to compensate the damage.
 

(7.4) All persons in the Castle are obliged to follow the safety requirements and internal rules. Spontaneous activities or irregularities are strictly at your own risk and may result in removal from the Castle and the territory of the Castle. Removal from the castle and its territory will not reimburse the cost of the ticket or event.

TICKET AND SERVICE PRICES

(8.1) The service provider has the right to change the price list at any time. If you have ordered the event but have not yet paid, the Service Provider guarantees the validity of the price list during the validity period of the price offer or invoice.
 

(8.2) The products of the service provider are sold through various agents and it is not always possible to check the nominal values of the price lists used on them. The Service Provider reserves the right not to accept a price that differs from the price established by the Service Provider.

RESPONSIBILITY

(9.1) The Service Provider is not responsible for the personal belongings and assets of the Customer and his / her group.
 

(9.2) The Client (the person responsible for the rental of tickets or premises) is fully responsible for the activities of the group represented by him, incl. undertakes to compensate in full the property damage caused to the Service Provider.

PROTECTION OF PERSONAL DATA

(10.1) The personal data collected for the processing of the Order is strictly for internal use.
 

(10.2) If the Customer has given consent, the Service Provider has the right to use the Customer’s contact information to post a newsletter.
 

(10.3) We confirm that the Customer’s personal data will not be disclosed to third parties for purposes other than the performance of the order.
 

(10.4) The Client’s financial data is not stored on the Service Provider’s servers.
